Ecclesiastical Jurisdiction (1857–1867)

As explained in the menu item marriage proceedings | norms, from January 1857 onwards married Catholic couples once again had to apply for a divorce from bed and board at Catholic marriage courts, where the regulations of canonical marriage law were again applied. Similar to the consistories before 1783, the episcopal marriage courts could also decide on a separate place of residence, provisional maintenance and provisional custody during the proceedings. The regulation of the secular effects of the divorce remained with the secular courts and was thus still subject to the General Civil Law Code of 1811.
